These Terms of Service (“Terms”) govern your use of compatible.dev (the “Site”), operated by Compatible Dev LLC (“Compatible Dev”, “we”, “us”). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
The Site and our services
The Site describes the software and engineering services Compatible Dev offers and lets you get in touch with us. It is provided for information only. Any services we actually perform for you, and any software we build or operate for you, are governed by a separate written agreement, such as a proposal, statement of work or master services agreement, and not by these Terms. If these Terms conflict with a signed agreement, the signed agreement controls for the work it covers.
Nothing on the Site is an offer that becomes binding on acceptance. We may change or discontinue any part of the Site at any time without notice.
Using the Site
You may use the Site for lawful purposes in connection with evaluating or working with Compatible Dev. You agree not to:
- copy, scrape, crawl or harvest content or data from the Site except as permitted by our robots.txt or applicable law;
- interfere with or disrupt the Site, its servers or its security, or attempt to gain unauthorized access to any part of it;
- submit false, misleading or spam inquiries, or impersonate any person or company;
- use the Site to send unsolicited commercial messages or to build a competing service;
- reverse engineer, frame or mirror any part of the Site without our written permission.
We may restrict or terminate access to the Site for anyone who violates these Terms.
Content and intellectual property
The Site and everything on it, including text, design, graphics, logos, diagrams, video, code and the arrangement of all of them, belong to Compatible Dev or its licensors and are protected by copyright, trademark and other laws. “Compatible” and the C mark are trademarks of Compatible Dev LLC and its affiliate Compatible Group LLC. You may view and print pages for your own evaluation of our services, but you may not otherwise reproduce, distribute, modify or create derivative works from Site content without our written permission.
Client names, logos and trademarks shown on the Site belong to their respective owners and appear to identify work we have done. Their appearance does not imply that those companies endorse Compatible Dev. Ownership of software and other deliverables we create for a client is set by that client’s agreement with us.
Systems, case studies and results
The Site describes systems we have built and results they produced. They reflect specific clients, stacks and conditions. They are illustrative, not a promise, and we make no guarantee that your project will deliver similar outcomes or that any system described will suit your needs. Descriptions of integrations and platforms do not imply endorsement by or partnership with those platforms unless stated.
Inquiries and submissions
When you contact us, you confirm that the information you provide is accurate and that you are authorized to share it on behalf of your company. Personal information you provide is handled under our Privacy Policy. Any ideas, feedback or suggestions you send about the Site or our services may be used by us without obligation to you. Do not send us confidential information before a written agreement covering confidentiality is in place.
We aim to reply to inquiries promptly, but we are not obligated to respond to or act on every submission.
Third-party sites and services
The Site links to third-party websites and services, including client sites and the platforms we integrate with, and loads analytics and advertising tools from third parties. We do not control and are not responsible for their content, availability or practices. Your use of them is at your own risk and subject to their terms.
Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Compatible Dev disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site’s content is complete, accurate or current.
Limitation of liability
To the fullest extent permitted by law, Compatible Dev and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, revenue, data or goodwill, arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
This section does not limit liability arising under a signed services agreement, which is governed by that agreement.
Indemnification
You agree to indemnify and hold harmless Compatible Dev and its members, officers, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Any claim must be brought within one year after it arises or it is permanently barred.
Changes to these Terms
We may revise these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Site after a change means you accept the revised Terms.
General
These Terms, together with the Privacy Policy, are the entire agreement between you and Compatible Dev regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
